PCC Draft Circular on Review of Solicited Public-Private Partnership (PPP) Projects

The Philippine Competition Commission (PCC) invites stakeholders, representatives from the business, legal and academic circles, trade association members, and interested individuals to submit their thoughts and comments on the PCC Draft Circular on Review of Solicited Public-Private Partnership (PPP) Projects.

This draft Circular aims to establish and institute a framework to facilitate the review of PPP projects, in the most expeditious and transparent manner, consistent with the mandate of the PCC and the objectives of the Build-Operate-and-Transfer Law.

The draft Circular shall apply solely to Solicited Projects undertaken by agencies and instrumentalities of the national government, including Government-Owned and Controlled Corporations (GOCCs), Government Financial Institutions (GFIs), and State Universities and Colleges (SUCs), pursuant to the BOT Law and its Implementing Rules and Regulations.

This draft Circular shall not apply to: (1) Solicited Projects undertaken by local government units (LGUs); (2) Unsolicited Proposals; and (3) joint ventures, which shall each be covered by separate issuances.

The public may send their comments via e-mail to mergers@phcc.gov.ph with subject title “Comments PCC-PPP Projects Circular,” or via mail to Philippine Competition Commission located at 25th Floor Tower 1, Vertis North Corporate Center, North Avenue, Quezon City 1105. Please ensure that comments will be received by the Mergers and Acquisitions Office on or before 26 March 2019.
